The IP Litigation Paralegal is responsible for providing support and assistance to attorneys in all aspects of IP litigation and U.S. Patent and Trademark Office (USPTO) proceedings before the Patent Trial and Appeal Board and Trademark Trial and Appeal Board, within established administrative procedures. A hybrid work schedule is available for this position.

Location: Chicago, IL

  • Assist in all aspects of IP litigation support, including related administrative matters.
  • Assist with district and appellate federal court proceedings, including filing documents.
  • Assist with USPTO proceedings, including filing documents, before the Patent Trial and Appeal Board and Trademark Trial and Appeal Board.
  • Independently follow legal procedures with advanced complexity.
  • Support trial preparation and assist in trials.
  • Assist with all stages and preparations regarding court hearings, arbitrations and mediations.
  • Perform factual research and identify documents and information required for additional review.
  • Participate in client and witness interviews and/or meetings. This includes document custodian and third party interviews.
  • Organize and conduct client file searches for responses to requests for production of documents.
  • Assist with discovery demands and responses.
  • Prepare log of documents withheld from productions, including privilege logs.
  • Prepare documents and exhibits for depositions of primary and expert witnesses in cases.
  • Proficient cite checking skills. This includes spelling and grammar checks, fact checking, sherardizing legal authority and blue-booking legal citations.
  • Track and complete projects within given deadlines.
  • Provide status updates throughout projects.
  • Perform other duties as assigned.

  • 4-6 years of IP paralegal experience. Paralegal Certificate preferred.
  • Bachelor's Degree required. Work experience in lieu of a degree will be considered.
  • Excellent communication skills, both verbal and written.
  • Ability to interact with internal and external personnel of all levels.
  • Attention to detail with the ability to meet varying deadlines in a fast-paced environment.
  • Some knowledge of eDiscovery trends.
  • Proficient in all aspects of IP litigation, including knowledge of district and appellate federal court rules and procedures.
  • Proficient knowledge of practice support systems and group specific software.
  • Continued collaboration with equivalent paralegals.
  • Proficient knowledge of applications typically used (i.e., Microsoft Office suite).
  • Proficient knowledge in working with electronic databases (i.e., Relativity and NetDocuments). This includes maintaining extranet databases and case files.
  • Solid organization and research skills.
  • Work independently with minimal oversight.
  • Working knowledge of the USPTO's website, including as it relates to PTAB and TTAB proceedings, and the ability to research the various patent and trademark rules and regulations.

In accordance with applicable Federal and State laws, the anticipated annual salary range for this position, depending on location, is as follows: Chicago, IL: $73,084 to $133,019.

In addition to a standard benefits package, this role may be eligible for additional contingent compensation based on an array of factors, including but not limited to: work performance, geographic location, work experience, education, and qualifications. Because such contingent compensation is not yet calculable or may be zero ($0) in some circumstances, the above-listed salary range(s) are Nixon Peabody's good faith estimate of the annual salary(ies) it reasonably expects to pay for the position at the time of this posting.
